Eos Systems Wins Against Cyber-squatter
Eos retrieves ownership of like-spelled domain name, photomodeller.com

Vancouver, BC, Canada - Eos Systems™, maker of the award-winning PhotoModeler® software, today announced that it has won a case with the World Intellectual Property Organization (WIPO) to retrieve ownership of the domain name photomodeller.com.

On Aug. 7, 2007 WIPO made a decision under the Uniform Dispute Resolution Policy (UDRP), case number D2007-0905, to transfer the ownership of the domain photomodeller.com from Keyword Marketing, Inc. to Eos Systems. The response dates have now expired, and the domain is fully under the control of Eos System. The web address www.photomodeller.com now points to the Eos product site: www.photomodeler.com.

Eos Systems had filed a US trademark registration for PHOTOMODELER, on December 16, 1993, and has actively used the name since for its world-leading photogrammetry software.  Eos Systems has used the photomodeler.com domain name since January 1995. In its filing with WIPO, Eos Systems contended that photomodeller.com, as a common misspelling (with only one extra L differentiating the names), was too close to its own trademark and domain name, and further that Keyword Marketing, Inc. had no legitimate use of the domain.

“The PhotoModeler name and brand is very well known all over the world and customers clearly identify this name with our products,” says company CEO Alan Walford.  “We are serious about the protection of our intellectual property and trademarks. We are pleased that WIPO has agreed with our position with respect to this domain and has awarded the transfer of ownership to us.”
